Information regarding data processing in the job application process in accordance with Art. 13 GDPR

Dear applicant,

The General Data Protection Regulation went into effect in May 2018. This regulated additional obligations with regard to the gathering of information. We have received personal data from you, and we process it as part of our application process. Therefore – in compliance with the new legally binding regulations - we shall inform you about any data processing we carry out.

If you do not give us consent to continue using this data, please send us a quick reply and we shall delete your data from our system – if we are legally allowed to do so. Otherwise, you can read below which personal data we have collected from you and processed and how we use this data.

The purpose and legal basis of data processing

The personal data of applicants is processed for the purpose of hiring new employees.

The legal basis of data processing for the purpose of creating an employment relationship proceeds in accordance with § 26 sec. 1 GDPR revised, as well as on the basis of consent in accordance with § 26 sec. 2 GDPR revised. Your consent is required if your personal data from the application process is to be saved with that of the other applicants or for transmission to subsidiary companies.

Categories of data recipients

The following recipients may be given access to the personal data you provide:

  • Internally - to employees of the HR department

  • Externally - to subsidiary companies

  • The Works Council

Duration of processing

Your personal data will be processed as part of the application process for a period of six weeks until a decision has been made. The application data will be archived for a period of six months after an application has been rejected and then destroyed.

Subject to your written consent, the option exists of putting your application into a pool of applicants. This pool allows subsequent consideration of an application you have already submitted. The saved data will be automatically deleted if your application is not reconsidered within a year.

Your rights as the person concerned

Right to information

You have the right to be informed, whether your personal data is being processed by our company. This information is supplied free of charge as a matter of course. It may be necessary to uniquely identify you before divulging any information.

On request, we agree to provide you with a one-off copy of the personal data we have used for processing purposes. We are entitled to charge an appropriate fee for each additional copy.

Right to rectification

You have the right to have incorrect personal data, that concerns you as a person, rectified. This includes the addition of information to complete data concerning you.

Right to have processing restricted

Under certain circumstances, you have the right to demand that the processing of your data by our company be restricted. This applies particularly if you dispute the accuracy of data, if the processing of data is carried out incorrectly, if the data is no longer required for processing purposes or if an objection to the data processing procedure has been raised.

Right to deletion

You have the right to prompt deletion of the personal data concerning you. Deletion may not ensue if processing is a result of the right to exercise freedom of expression, if the data is required to fulfil legal obligations, if there is public interest in processing the data within the realm of public health, if data is being processed for archiving purposes or historical and scientific research purposes or if processing is necessary for the defence of legal claims.

Right to object

You have the right to object to the processing of personal data concerning you at any time.

Right to data portability

You have the right to receive personal data concerning you, which is processed within the scope of a defined purpose, in a structured and standard machine-readable format. On request, this data can also be directly disclosed by our company to another responsible party.

Right to withdraw

If the processing of personal data is based on your voluntary consent, you have the right to withdraw your consent at any time. Withdrawal of consent is valid for the future only. Already completed processing transactions remain unaffected by any withdrawal of consent.

Right to lodge a complaint

You are at liberty to contact the responsible supervisory authority for data protection if you believe that the processing of your data is in breach of data protection laws or if your rights under data protection law have been violated in any other way.
